I. General Provisions

Personal data means any information relating to an identified or identifiable natural person; an identifiable person is one who can be directly or indirectly identified, especially by reference to an identifier such as name, identification number, location data, network identifier, or one or more specific elements of the physical, physiological, genetic, mental, economic, cultural, or social identity of that person.

II. Sources and Categories of Personal Data Processed

1. The controller processes personal data that you have provided or personal data obtained based on fulfilling your order.

2. The controller processes your identification and contact details, as well as data necessary for the fulfillment of the contract.

III. Legal Basis and Purpose of Processing Personal Data

The legal basis for the processing of personal data is:

  1. the performance of a contract between you and the controller under Article 6(1)(b) of the GDPR,
  2. the legitimate interest of the controller in providing direct marketing (especially for sending commercial communications and newsletters) under Article 6(1)(f) of the GDPR,
  3. your consent to the processing of personal data for direct marketing purposes (especially for sending commercial communications and newsletters) under Article 6(1)(a) of the GDPR in connection with Section 7(2) of Act No. 480/2004 Coll., on certain information society services, in the case where no goods or services were ordered.

The purpose of processing personal data is:

  1. to process your order and perform the rights and obligations arising from the contractual relationship between you and the controller; personal data required for processing the order (name, address, contact) must be provided for the contract to be concluded and performed. Without providing personal data, the contract cannot be concluded or fulfilled by the controller,
  2. sending commercial communications and performing other marketing activities.

The controller does / does not engage in automated individual decision-making under Article 22 of the GDPR. You have provided your explicit consent to such processing.

IV. Data Retention Period

The controller retains personal data:

  1. for the period necessary to perform the rights and obligations arising from the contractual relationship between you and the controller and to assert claims from these contractual relationships (for 15 years after the end of the contractual relationship),
  2. for the period until consent to the processing of personal data for marketing purposes is withdrawn, at most ... years, if personal data is processed based on consent.

After the retention period has expired, the controller will delete the personal data.

V. Recipients of Personal Data (Subcontractors of the Controller)

The recipients of personal data are persons:

  1. involved in the delivery of goods/services/payment execution based on the contract,
  2. providing e-shop operation services (Shoptet) and other services in connection with the e-shop's operation,
  3. providing marketing services.

The controller does / does not intend to transfer personal data to a third country (outside the EU) or an international organization. Recipients of personal data in third countries are providers of mailing/cloud services.

VI. Your Rights

Under the conditions set forth in the GDPR, you have the right to:

  1. access your personal data under Article 15 of the GDPR,
  2. correct your personal data under Article 16 of the GDPR, or restrict processing under Article 18 of the GDPR,
  3. request the deletion of your personal data under Article 17 of the GDPR,
  4. object to the processing of your personal data under Article 21 of the GDPR, and
  5. the right to data portability under Article 20 of the GDPR.
  6. You also have the right to withdraw your consent to processing in writing or electronically at the address or email of the controller listed in Article III of these terms

You also have the right to lodge a complaint with the Office for Personal Data Protection if you believe that your right to personal data protection has been violated.

VII. Personal Data Security Conditions

1. The controller declares that it has taken all appropriate technical and organizational measures to secure personal data.

2. The controller has taken technical measures to secure data storage and storage of personal data in paper form

3. The controller declares that personal data can only be accessed by authorized persons.

VIII. Final Provisions

1. By submitting an order via the online order form, you confirm that you have read and accept the personal data protection conditions in full.

2. You agree to these conditions by ticking the consent box via the online form. By ticking the consent box, you confirm that you have read and accept the personal data protection conditions in full.

3. The controller is entitled to change these conditions. The new version of the personal data protection conditions will be published on its website, and a new version of these conditions will also be sent to your email address that you have provided to the controller.

These conditions come into effect on February 24, 2020.
